Relocation Toolkit

There are many areas of concern families overlook with their estate plans when they move:

  • If your plan is not reviewed or updated to reflect changes in your assets or your family’s situation (births, divorces, blended families, adoptions), your assets may not be distributed or handled as you intended
  • If you purchase property in a new state and do not put it in the name of a Trust, it will be subject to probate at your death (costs and time varies by state)
  • If you become incapacitated, your Health Care Directives and Powers of Attorney may not work in the new state and you could go through a conservatorship — a public and humiliating court process
  • If you pass away while owning property in multiple states, your heirs may have to go through multiple probates — this can significantly eat up the inheritance you hope to leave them and require burdensome travel
  • If you sell your home, it may affect your eligibility for Medicaid and other long- term care benefits — some states make it easy to qualify, while others impose more significant restrictions
  • Each state assesses income, gift, estate, and inheritance taxes differently, including assets held in Trust, which means you could end up paying a lot more in taxes than you previously planned
